In-Custody Death Investigation - 07-10-2024
On 7/5/2024, at approximately 6:41 P.M., deputies assigned to the Main Jail Facility in San Jose located Jose Herrera (24) unresponsive in his assigned cell. Deputies and medical staff immediately performed life-saving measures on him by administering CPR until medical personnel arrived.
At approximately 6:55 P.M., San Jose Fire and Emergency Medical Services arrived on scene and transported Herrera to a local hospital for further assessment.
Sheriff’s Detectives responded to both the Main Jail Facility and the hospital to conduct an investigation. Herrera was housed alone in his cell at the time of the incident.
On 7/10/2024, at approximately 2:31 P.M., Herrera was pronounced deceased while in the care of a local hospital.
Herrera was arrested by Sheriff’s Deputies and booked into the Santa Clara County Main Jail on 7/5/2024 for two counts of Robbery, Possession of a Loaded Firearm, various other felonies, and several outstanding warrants.
The Sheriff’s Office followed standard protocol for an in-custody death by conducting a joint investigation among the Sheriff’s Office, District Attorney’s Office, and the Santa Clara County Medical Examiner – Coroner’s Office. The Medical Examiner – Coroner’s Office has determined the cause of death was hypoxic-ischemic encephalopathy due to hanging, with the manner of death being suicide.
