In-Custody Death Investigation - 02-17-2024

On 2/17/2024, at approximately 11:23 A.M., deputies assigned to the Elmwood Correctional Facility in Milpitas located an unresponsive 57-year-old man in his assigned barrack. Deputies and medical staff immediately performed life-saving measures on the individual by administrating CPR until medical personnel arrived.

At 11:34 A.M., the Milpitas Fire Department and Emergency Medical Services arrived on scene and pronounced the adult male deceased at 11:39 A.M. The decedent was housed in an open barrack at the time of incident. Sheriff’s Office Detectives responded to the scene to conduct an investigation. Preliminary information showed no evidence of foul play or suspicious circumstances leading to the death.

The decedent was booked into the Santa Clara County Main Jail on 12/14/2023 for P.C. 459.5(a), P.C. 460(b), P.C 484(a), and two counts of P.C. 487(a).

The Sheriff’s Office is following standard protocol for an in-custody death by conducting a joint investigation among the Sheriff’s Office, District Attorney’s Office, and the Santa Clara County Medical Examiner-Coroner’s Office. The name of the decedent is being withheld until notification to next of kin.
